1. Acceptance of Terms
These Terms of Use (“Terms“) constitute a legally binding agreement between you (“you,” “your,” or “User“) and Field Service Guide (“Field Service Guide,” “we,” “us,” or “our“), the operator of the website located at https://fieldserviceguide.com and any related subdomains, mobile sites, or applications (collectively, the “Site” or “Service“). By accessing, browsing, or otherwise using the Site, submitting any form, clicking any affiliate link, or engaging with any content on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease using the Site.
2. Eligibility
You must be at least eighteen (18) years of age and legally capable of entering into binding contracts under the laws of your jurisdiction to use the Site. By using the Site, you represent and warrant that you meet these eligibility requirements. The Site is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If you are using the Site on behalf of a business, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.
3. Description of Service
Field Service Guide is an independent editorial publication that provides reviews, comparisons, rankings, buying guides, educational content, and related resources concerning field service management software, contractor software, dispatch software, and related technology products and services (collectively, “Reviewed Products“). The Site may include, without limitation, written reviews, comparison tables, scoring methodologies, calculator tools, recommendation engines, newsletters, and forms through which Users may request information, demos, quotes, or other materials from third-party vendors.
4. Editorial Independence and Methodology
Field Service Guide is an independent, AI-enabled research publication. Our content reflects editorial judgment applied to comprehensive synthesis of publicly available information — including vendor documentation, pricing disclosures, customer reviews aggregated across multiple platforms (G2, Capterra, TrustRadius, GetApp, Software Advice, and others), independent industry coverage, and community discussions. We do not conduct hands-on field trials of every platform we review. Our rankings, scores, and recommendations reflect our synthesis and editorial judgment based on that public evidence. You acknowledge and agree that:
- Product rankings, scores, and recommendations reflect our opinions and editorial judgment as of the date of publication and may change at any time without notice.
- We use artificial intelligence to synthesize and analyze large volumes of public data, and all AI-assisted analysis is reviewed and validated by a human editor before publication.
- We may receive compensation (including, without limitation, affiliate commissions, referral fees, cost-per-lead (“CPL“) payments, cost-per-acquisition (“CPA“) payments, sponsorship fees, and advertising revenue) in connection with products or services featured on the Site. Such compensation does not influence our rankings or editorial content.
- Not every product available in the market is reviewed on the Site. The absence of a product from the Site does not constitute a negative review or endorsement of competing products.
- Pricing, features, and product specifications displayed on the Site are based on information obtained from vendors, public sources, and our own research and may be inaccurate, outdated, or incomplete. You should verify all such information directly with the vendor before making a purchasing decision.
5. Affiliate Disclosure (FTC 16 CFR Part 255)
In accordance with the Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255), we disclose that Field Service Guide is a participant in affiliate marketing programs, lead generation arrangements, and other referral or commission-based compensation arrangements with third-party vendors. This means that when you click certain links on the Site and subsequently purchase a product, subscribe to a service, submit a demo request, complete a form, or take other specified actions, we may receive compensation at no additional cost to you. 6. Lead Generation and Third-Party Submissions
Certain features of the Site, including but not limited to “Find My Software,” “Get a Quote,” “Request a Demo,” comparison tools, calculators, recommendation engines, and similar interactive forms (collectively, “Lead Forms“), allow you to submit information that we will share with one or more third-party vendors, partners, lead buyers, or service providers (collectively, “Partners“). By submitting a Lead Form, you expressly acknowledge and agree that:
- The information you submit will be transmitted to one or more Partners for the purpose of responding to your inquiry, offering products or services, and/or following up with you via phone, email, SMS/text message, or other means.
- You consent to be contacted by us and our Partners at the telephone number(s), email address(es), and other contact details you provide, including via automatic telephone dialing systems, artificial or prerecorded voice messages, and SMS/text messages, for marketing and informational purposes. You acknowledge that such consent is not a condition of purchasing any goods or services.
- Standard message and data rates may apply to any SMS/text messages you receive. You may opt out of SMS marketing at any time by replying “STOP” to any text message.
- You are providing your express written consent under applicable law, including without limitation the Telephone Consumer Protection Act (“TCPA“), 47 U.S.C. § 227, and implementing regulations, to receive such communications.
- Partners’ handling of your information is governed by their own privacy policies, and we are not responsible for their privacy or data security practices.
- We may retain the information you submit for our own business, marketing, and analytics purposes, as further described in our Privacy Policy.
- We may receive compensation from Partners for each lead transmitted, whether or not you ultimately purchase from any Partner.
7. No Professional Advice
Content on the Site is provided for general informational and educational purposes only and does not constitute professional, legal, financial, tax, accounting, investment, business, technological, or any other form of advice. You should not act or refrain from acting on the basis of any content on the Site without seeking appropriate professional advice from a qualified advisor familiar with your specific circumstances. No attorney-client, fiduciary, consultant-client, or other professional relationship is formed by your use of the Site.
8. Intellectual Property Rights
The Site and all of its content, including without limitation text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, code, review methodologies, scoring systems, comparison charts, rankings, editorial features, and the design, selection, arrangement, and “look and feel” of the Site (collectively, “Site Content“) are owned by Field Service Guide or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, trade secret, and other intellectual property laws. All rights are reserved.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for your personal, non-commercial use. Except as expressly permitted by these Terms, you may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, scrape, data-mine, or otherwise exploit any Site Content without our prior written consent. Any unauthorized use terminates the license granted by us.
“Field Service Guide,” the Field Service Guide logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Field Service Guide or its affiliates. Third-party trademarks referenced on the Site are the property of their respective owners and are used for identification and editorial purposes only. Reference to any third-party trademark does not imply endorsement or affiliation.
9. User Submissions and User-Generated Content
If you submit, post, upload, or otherwise transmit any comment, review, rating, testimonial, photograph, suggestion, idea, or other content to the Site (“User Content“), you grant Field Service Guide and its affiliates, successors, and assigns a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, fully sublicensable and transferable right and license to use, reproduce, distribute, prepare derivative works of, publicly display, publicly perform, modify, adapt, translate, and otherwise exploit such User Content, in any and all media now known or later developed, without compensation to you and without any obligation to credit you.
You represent and warrant that: (a) you own or have the necessary rights, licenses, consents, and permissions to grant the license set forth above; (b) the User Content does not infringe, misappropriate, or violate any third party’s intellectual property, publicity, privacy, or other rights; (c) the User Content is truthful, accurate, and not misleading; and (d) the User Content complies with these Terms and all applicable laws.
10. Prohibited Conduct
You agree not to use the Site in any manner that, or to engage in any conduct that:
- Violates any applicable federal, state, local, or international law, regulation, or rule;
- Infringes or violates the intellectual property, publicity, privacy, contract, or other rights of any person or entity;
- Is false, misleading, defamatory, obscene, pornographic, harassing, threatening, abusive, hateful, or otherwise objectionable;
- Involves transmitting unsolicited advertising, spam, chain letters, pyramid schemes, or other unauthorized solicitation;
- Uses any robot, spider, scraper, crawler, screen-scraping software, or other automated means to access the Site or extract data from it without our prior written consent;
- Attempts to reverse-engineer, decompile, disassemble, or otherwise derive source code from the Site;
- Interferes with, disrupts, overloads, impairs, or attempts to circumvent any security or access-control mechanism of the Site;
- Uses the Site to transmit any malware, virus, trojan horse, worm, time bomb, or other harmful code;
- Impersonates any person or entity or misrepresents your affiliation with a person or entity;
- Submits false, inaccurate, incomplete, or fraudulent information through any Lead Form;
- Manipulates, attempts to influence, or fraudulently generates affiliate commissions, leads, or referrals; or
- Otherwise attempts to interfere with the proper working of the Site.
11. Third-Party Links, Products, and Services
The Site contains links to third-party websites, products, services, advertisements, and content (including affiliate links and Partner websites). Such links are provided for your convenience and reference only. We do not endorse, control, or assume any responsibility for the content, privacy practices, terms of service, quality, accuracy, or availability of any third-party sites, products, or services. Your interactions with any third party (including Partners) are solely between you and that third party, and we disclaim all liability arising from any such interactions or transactions.
12. Disclaimers; No Warranty
THE SITE AND ALL SITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIELD SERVICE GUIDE, ITS AFFILIATES, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, OR THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT: (A) THE SITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) INFORMATION OBTAINED FROM OR THROUGH THE SITE WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT; (D) DEFECTS WILL BE CORRECTED; (E) THE SITE OR ANY SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (F) ANY PRODUCT, SERVICE, OR VENDOR REFERENCED ON THE SITE WILL PERFORM AS DESCRIBED OR MEET YOUR NEEDS.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SITE OR FROM FIELD SERVICE GUIDE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIELD SERVICE GUIDE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY SITE CONTENT, ANY PRODUCT OR SERVICE OF ANY PARTNER, OR ANY INTERACTION WITH ANY PARTNER OR OTHER THIRD PARTY, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF FIELD SERVICE GUIDE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF FIELD SERVICE GUIDE AND ITS AFFILIATES FOR ALL CLAIMS RELATING TO THE SITE EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNT YOU PAID DIRECTLY TO FIELD SERVICE GUIDE, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to defend, indemnify, and hold harmless Field Service Guide, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, demands, actions, suits, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Site; (b) your User Content or information submitted through any Lead Form; (c) your breach or alleged breach of these Terms; (d) your violation of any law or the rights of any third party; or (e) your interactions or transactions with any Partner or other third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
15. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH FIELD SERVICE GUIDE AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site (each, a “Dispute“) shall be resolved exclusively through final and binding individual arbitration, except that: (a) either party may bring an individual action in small-claims court; and (b) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
The arbitration shall be administered by the American Arbitration Association (“AAA“) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single neutral arbitrator. The seat and location of the arbitration shall be the State of Delaware, United States, unless the parties agree otherwise or the arbitrator determines that a different location would be more convenient. The arbitration shall be conducted in the English language.
YOU AND FIELD SERVICE GUIDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this Section 15 shall be null and void.
You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to the contact address set forth below within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
16. Governing Law and Jurisdiction
These Terms and any Dispute arising out of or relating to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Subject to Section 15, you agree that any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.
17. Termination
We reserve the right, in our sole discretion and without notice or liability, to suspend, terminate, or restrict your access to all or any portion of the Site at any time and for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute-resolution provisions.
18. Modifications to the Site and Terms
We reserve the right, at our sole discretion, to modify, discontinue, or add to any portion of the Site at any time without notice. We may revise these Terms from time to time. The revised Terms will become effective upon posting, and your continued use of the Site following the posting of revised Terms constitutes your acceptance of the changes. The “Last Updated” date at the top of these Terms indicates when they were last revised. You are responsible for periodically reviewing these Terms.
19. Electronic Communications and Signatures
By using the Site, you consent to receive electronic communications from us, including notices and disclosures, and you agree that such electronic communications satisfy any legal requirement that such communications be in writing. You further agree that clicking to accept, submitting a form, or otherwise taking any affirmative action on the Site constitutes your electronic signature, consent, and acceptance to any corresponding agreement, to the fullest extent permitted by the E-SIGN Act and applicable state laws.
20. Digital Millennium Copyright Act (DMCA)
We respect the intellectual property rights of others and expect our users to do the same. If you believe in good faith that material on the Site infringes your copyright, you may submit a notice pursuant to the DMCA, 17 U.S.C. § 512, by providing our designated agent with the following information in writing: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner; and (f) your physical or electronic signature. Notices may be sent to the email address listed in Section 22.
21. Severability; Waiver; Entire Agreement; Assignment
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Field Service Guide concerning the Site and supersede all prior agreements and understandings. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
