Professional and business information: information about the nature of your business, number of employees, trade vertical (HVAC, plumbing, electrical, landscaping, pest control, etc.), software budget, purchase timeline, current software, pain points, and preferences;
Communications: messages, inquiries, feedback, and correspondence you send to us via email, SMS, or through the Site;
User-generated content: comments, reviews, ratings, testimonials, or other content you post on the Site;
Marketing preferences: your email subscription preferences and consents.

2.2 Information Collected Automatically

When you access the Site, we and our service providers automatically collect certain information about your device and usage, including:

3. How We Use Your Information

To fulfill Lead Form submissions by matching you with relevant Partners, transmitting your information to such Partners, and enabling those Partners to contact you;
To communicate with you, including to respond to inquiries, send transactional messages, newsletters, product updates, promotional offers, surveys, and administrative notices (you may opt out of marketing communications at any time as described in Section 9);
To personalize your experience by recommending products, displaying relevant content, and tailoring advertising;
For marketing, advertising, and promotional purposes, including retargeting advertising, lookalike audience building, and measurement of advertising effectiveness;
To analyze Site performance and user behavior and improve the Site, our content, our methodologies, and our business operations;
To prevent, detect, and investigate fraud, security incidents, abuse, and other prohibited or illegal activity, including verification of leads, deduplication, and protection against lead stuffing or synthetic traffic;
To comply with applicable laws, regulations, legal process, and enforceable governmental requests, and to enforce our Terms of Use and other policies;
To defend legal claims or protect the rights, property, or safety of Field Service Guide, our users, our Partners, or the public;

4. How We Share and Disclose Information

We share your information in the following circumstances:

4.1 With Partners (Lead Generation)

When you submit a Lead Form, you expressly authorize us to share the information you provide (including without limitation your name, email, phone number, business details, and inquiry details) with one or more Partners that we believe may be able to satisfy your inquiry. Partners may include software vendors, resellers, implementation consultants, financing providers, and other third parties. Partners will use your information in accordance with their own privacy policies, which we encourage you to review. Once your information is transmitted to a Partner, we cannot control how that Partner uses, retains, or further discloses it.

4.2 With Service Providers

We share information with third-party service providers that perform services on our behalf, including web hosting, content delivery, analytics, advertising, email delivery, SMS delivery, CRM, marketing automation, lead scoring and verification, fraud prevention, payment processing, customer support, and professional advisory services. These providers are authorized to use your information only as necessary to provide services to us and are contractually required to protect your information.

4.3 With Advertising and Analytics Partners

We share information with advertising networks, analytics providers, social media platforms, and similar partners for purposes including interest-based advertising, retargeting, attribution, audience building, and performance measurement. This sharing may constitute a “sale” or “sharing” of personal information under certain state privacy laws, as further described in Section 10.

4.4 For Legal, Safety, and Enforcement Reasons

We may disclose information to courts, regulators, law enforcement, and other authorities: (a) to comply with applicable law, legal process, or governmental request; (b) to enforce our Terms of Use or other agreements; (c) to detect, prevent, or address fraud, security, or technical issues; or (d) to protect the rights, property, or safety of Field Service Guide, our users, Partners, or others.

4.5 In Corporate Transactions

4.6 With Your Consent

5. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal, tax, regulatory, accounting, and reporting obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed, we will delete, anonymize, or aggregate it in accordance with our internal retention policies and applicable law. Retention periods vary by data category; for example, lead submissions may be retained for the duration of the commercial relationship plus a reasonable period thereafter for legal and business purposes.

6. Cookies and Similar Tracking Technologies

We and our third-party providers use cookies and similar technologies (including web beacons, pixels, tags, local storage, and software development kits) to collect information automatically. The categories of cookies we use include:

Strictly Necessary Cookies required for the Site to function, such as session management and security;
Performance and Analytics Cookies (including Google Analytics 4, Microsoft Clarity, and similar) that help us understand how visitors use the Site;
Functional Cookies that remember your preferences and enable enhanced functionality;

These third parties may collect or receive information about your use of the Site and may combine it with information they have collected from other sources. Their practices are governed by their own privacy policies, and we are not responsible for their practices. We encourage you to review the privacy policies of any third-party services you use.

8. Telephone, SMS, and Email Communications Consent (TCPA)

By submitting a Lead Form that includes your telephone number, you expressly consent to be contacted by us and our Partners at the number(s) you provide, including via automatic telephone dialing systems, artificial or prerecorded voice messages, and SMS/text messages, for marketing and informational purposes. You acknowledge that such consent is not a condition of purchasing any goods or services and that standard message and data rates may apply. You may revoke this consent at any time by replying “STOP” to any SMS or by contacting us at the address in Section 15. Revocation of consent will stop future marketing communications but may not prevent transactional or service-related communications necessary to respond to your prior inquiries.

9. Your Choices and Opt-Out Rights

You have the following choices regarding your information:

Email marketing: You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing email or by contacting us directly;
SMS marketing: You may opt out of SMS marketing by replying “STOP” to any text message;
Cookies: You may adjust your browser settings to refuse cookies or use the industry opt-out tools identified in Section 6;
Interest-based advertising: You may opt out of Google’s personalized advertising via Google Ad Settings and Meta’s via your Facebook Ad Preferences;
Do Not Track: Some browsers offer a “Do Not Track” signal. Because there is no industry-standard consensus on how to respond to these signals, we do not currently respond to them. We will reassess this position as standards evolve.

10. State Privacy Rights

10.1 California Residents (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA“). These rights include: (a) the right to know the categories and specific pieces of personal information we collect, use, disclose, and sell/share about you; (b) the right to delete personal information subject to certain exceptions; (c) the right to correct inaccurate personal information; (d) the right to opt out of the “sale” or “sharing” of your personal information, including for cross-context behavioral advertising; (e) the right to limit the use or disclosure of sensitive personal information; and (f) the right not to receive discriminatory treatment for exercising your rights.

Categories of personal information collected in the past 12 months include identifiers, commercial information, internet or other network activity, geolocation data, professional or employment-related information, and inferences drawn from the foregoing. We disclose these categories to service providers, Partners, and advertising/analytics partners as described in this Policy. We “sell” or “share” personal information (as those terms are defined under the CCPA) with advertising and analytics partners for cross-context behavioral advertising purposes. We do not knowingly sell or share the personal information of individuals under 16.

To exercise your rights, please submit a request by emailing privacy@fieldserviceguide.com with the subject line “California Privacy Request.” We will verify your identity before responding. You may also designate an authorized agent to submit a request on your behalf. You may exercise your right to opt out of the sale/sharing of personal information by clicking “Do Not Sell or Share My Personal Information” in the footer of the Site or by sending a Global Privacy Control signal from a supported browser.

10.2 Other U.S. States

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Indiana, Tennessee, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, or another state with comprehensive consumer privacy legislation, you may have similar rights to access, correct, delete, and port your personal information, and to opt out of targeted advertising, sales of personal information, and certain profiling activities. To exercise these rights, please submit a request by emailing privacy@fieldserviceguide.com and identifying your state of residence.

11. International Users and Data Transfers

The Site is operated from the United States and is intended for users located in the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States or other jurisdictions where our service providers operate. These jurisdictions may have data-protection laws that differ from, and may be less protective than, those of your country. By using the Site, you consent to such transfers. We do not currently target or market the Site to residents of the European Economic Area, the United Kingdom, or Switzerland; however, if you are located in one of these regions, you may have additional rights under the General Data Protection Regulation or analogous laws, which you may exercise by contacting us at the address in Section 15.

12. Children’s Privacy

The Site is intended for business professionals and is not directed to children under the age of 18. We do not knowingly collect personal information from children under 13 in accordance with the Children’s Online Privacy Protection Act (“COPPA“). If we learn that we have collected personal information from a child under 13, we will promptly delete that information. If you are a parent or guardian and believe your child has submitted information to us, please contact us at the address in Section 15.

13. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we collect against loss, theft, misuse, unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any credentials you use to access the Site.

14. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will post the revised Policy on the Site and update the “Last Updated” date. We may also provide additional notice, such as via email or a prominent notice on the Site. Your continued use of the Site following the posting of revised terms constitutes your acknowledgment and acceptance of the changes.
